Wills and Estates Legal Fees

At Browne Linkenbagh Legal Services we understand that legal costs are an important issue for many of our clients.  We like to be upfront and transparent about our fees.  We also know that certainty is a big issue, which is why we offer fixed fee and set pricing for many services.

These are outlined below.

Our estate planning is charged at the hourly rate for the solicitor you consult.

For a Special Counsel or Accredited Specialist
$660 per hour plus GST or $808 per hour plus GST for large or complex estate planning

For a Senior Solicitor
$550 per hour plus GST

Overview for Estate Planning

Our Estate Planning meetings start with an initial consultation to discuss your needs.  We then provide a quote to commence preparation of your documents based on your instructions.

We do not proceed with any drafting until you confirm that you wish to proceed based on our cost estimate.

If you do not proceed the initial meeting is charged based on the time taken (usually between 1-2 hours depending on the complexity of your matter).  Our usual charges are about $1500 for an individual and $3000 for a couple subject to what is required.

Estate litigation is charged at the hourly rate of the solicitor dealing with your matter.

For Darrly Browne – Accredited Specialist and estates expert
$880 per hour plus GST

For Special Counsel and litigation expert
$770 per hour plus GST

For Senior Solicitor
$660 per hour plus GST

For all litigation matters, a cost agreement will be provided to you after your initial meeting and updates throughout your matter on expected fees and charges.  There may also be additional fees if a Barrister is briefed and additional filing fees at the court once the application is commenced.  All rates exclude disbursements.

These matters are charged at the hourly rate of the solicitor dealing with your matter for the initial meeting.  This usually goes for 1-2 hours.

For a Special Counsel or Accredited Specialist
$660 per hour plus GST

For a Senior Solicitor
$550 per hour plus GST

If instructions are provided to proceed with the application by the executor or next of kin, then our fees for obtaining the grant only are charged at the scale rate set by the Supreme Court of NSW.  The scale can be found on the website.

Once a grant of probate or letters of administration is received, then work for administration of the estate is charged as per the hourly rate of the staff member working on the matter.

For a Special Counsel or Accredited Specialist
$660 per hour plus GST

For a Senior Solicitor
$550 per hour plus GST

Senior Paralegal
$330 per hour plus GST

Fees for residential conveyancing are charged as a fixed fee as outlined below and exclude disbursements:-

For preparation of the contract for sale $1030

For initial advice in respect to purchase of real property $660

For initial advice in respect to purchase of a vacant block of land $915

For any further work post exchange to settlement:-

Commercial/Industrial Purchase or sale

$2500 for a purchase

$3500 for a sale

Discharge of mortgage/Notice of Death/Transmission Applications/Caveats

These are charged at $1000 per property.

Other extra work is subject to negotiation based on the hourly rates, such as:

• GST rulings
• Off the plan purchases and sales
• Unregistered land purchases/sales
• Rural land
• Permit to close land
• Old system
• Qualified title
